Rapid Fire Guide to Property Purchase


An independent valuation will confirm the validity of the asking and selling prices and bring to the attention of the purchaser and vendor any anomalies.


This is the contract between buyer and seller which is drawn up after agreement has been reached on an offer made by the prospective buyer. A 10% deposit is paid to the seller by the buyer, the ‘Compra-Venta’ contract is signed and held by lawyers of both parties until the sale is finalised. Should the buyer break the agreement the deposit will be retained by the seller. If, on the other hand the contract is broken by the seller, it would then be his/her responsibility to pay the buyer double the amount, less any applicable fees, in compensation.


Buying and selling parties go before the public notary to sign the deeds and the keys are exchanged.

Balearic Buying – at a glance

  • Check with the Land Registry Office that the seller is in fact registered as the owner of the property. (unlike in most European countries registration is not compulsory in Spain)
  • Scrutinise the dimensions and description of the property and plot when checking the registry, to ensure all details are accurate and that you know exactly what you are getting for your money
  • Check the cadastre which will include previous owners and details of any original properties that have been divided up in the past. Division of property could complicate demarcating of borders and cause real estate tax issues.
  • If it is a new property, you need to check that the Council has issued the occupancy certificate, to avoid subsequent problems.
  • If buying an apartment ensure that the seller has paid all due community fees to avoid liability to pay any arrears.
  • Seek professional legal advice on matters of property transfer tax, registry inscription costs, capital gains tax etc
